How to terminate legally?

Firing someone because of just cause is legal in any setting. Just cause should be defined in the construction employee manual, but even if it is not clearly defined, the courts support "just cause" as someone who did not perform the task for which she was hired successfully. Any ethical, civil or criminal violations also justify termination. Lay offs are another option instead of termination, however lay offs may result in construction employer obligations with unemployment pay, etc.
